These Terms and Conditions ("Terms") govern your use of the 12 Stone, LLC website and the masonry and hardscaping services we provide. By accessing our website, requesting an estimate, or engaging us for work, you agree to be bound by these Terms. Please read them carefully. Specific projects are also governed by the written service agreement you sign with us, which controls in the event of any conflict with these Terms.

1. Acceptance of Terms

By accessing or using the 12 Stone, LLC website and services, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, please discontinue use of our website and services.

2. Services and Service Agreement

12 Stone, LLC provides masonry and hardscaping services including custom stone installation, brick and stone veneer, residential and commercial masonry, hardscaping, outdoor living spaces, retaining walls, fire pits, fireplaces, and repairs and restoration. All work is performed pursuant to a written estimate and service agreement that sets out the scope of work, materials, schedule, and price for your specific project.

The service agreement, together with these Terms, constitutes the entire understanding between you and 12 Stone, LLC for the work described, and supersedes any prior verbal or written discussions.

3. Estimates and Pricing

Estimates are based on the scope of work, site conditions, and material selections discussed at the time of quoting. Estimates are valid for the period stated and may be revised if the scope, materials, site conditions, or applicable costs change. Final pricing is confirmed in your written service agreement prior to the start of work.

4. Payment Terms

Payment terms, including any required deposit and progress payments, are specified in your service agreement.

  • A deposit is typically required to schedule your project and order materials.
  • Progress payments may be due at defined milestones for larger projects.
  • Final payment is due upon substantial completion of the work.
  • Late or missed payments may result in suspension of work and may accrue interest or fees as permitted by law.

5. Project Changes and Delays

Any change to the agreed scope of work must be documented in a written change order signed by both parties, and may affect the price and schedule. We are not responsible for delays caused by circumstances beyond our reasonable control, including weather, material availability, permitting and inspections, site access, or other events constituting force majeure. We will make reasonable efforts to communicate and reschedule promptly when delays occur.

6. Warranties

Workmanship Warranty

We stand behind our craftsmanship and provide a workmanship warranty as specified in your service agreement. This warranty covers defects in our installation under normal use and conditions.

Limitations

Our workmanship warranty does not cover damage resulting from normal wear, settling, ground movement, water intrusion not caused by our work, improper maintenance, alterations by others, or acts of nature. Manufacturer warranties, where applicable, apply to materials and are provided directly by the manufacturer. Natural stone and masonry products may vary in color, texture, and veining, and such variation is not considered a defect.

7. Limitation of Liability

To the fullest extent permitted by law, 12 Stone, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to our website, services, or these Terms. Our total aggregate liability for any claim arising out of a project shall not exceed the total amount paid by you for that project. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Client Responsibilities

You agree to:

  • Provide safe and reasonable access to the work site.
  • Disclose the location of underground utilities, irrigation, and other concealed conditions known to you.
  • Obtain any required homeowner association or property owner approvals.
  • Make timely decisions and payments as set out in your service agreement.

9. Intellectual Property

All content on this website, including text, images, project photos, and logos, is the property of 12 Stone, LLC and may not be copied, reproduced, or distributed without our prior written permission.

10. Governing Law

These Terms and any service agreement are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. The exclusive venue for any dispute shall be the state or federal courts located in Wake County, North Carolina.

11. Dispute Resolution

In the event of a dispute, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved informally, the parties agree to pursue mediation in Wake County, North Carolina before initiating litigation. Each party shall bear its own costs unless otherwise awarded by a court of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised date and will apply to use of our website and services after the posting date.
